Hosting terms and the agreement of use

 1-This agreement points agrees with the customary international and local systems in the hosting field.

2- Golden Fibers company has the right to update the items of the agreement of use if necessary.

3- At the client approval of the services of hosting that the company offers, he is considered an approver completely on all the agreement of use items.

4- The agent is required to sign this agreement personally with certified sealing of the company he runs or he represents. He has to fill a form information of the name of the site scope enclosed with this agreement for recording these information in the connection information in the name of site scope (Site Domain ).

5- Golden Fibers company hosts the sites of the commercial companies and the industrial ones or what it resembled, and Golden Fibers company apologizes about hosting the personal sites or that contains no commercial or industrial data. Therefore,  defining the terms related to the contents of the hosted sites on the company servers are in the next items :

A- The site contains data that facilitate the companies to communicate its customers, and these data are related exclusively to these companies .

B- The companies benefit from the services of e-mail within their sites in especial and restrict way in the continuation with their agents and prevent the use of services of the e-mail in sending the troublesome or illegitimate publicity messages (Spam). The agent understands any damages resulting from these forbidden messages according to the international laws and the local laws. In case of the receipt of report to Golden Fibers company from the international organization of following spam, deletion of site takes place finally and it is not legal for the agent to ask Golden Fibers company by any financial moral compensations according to the international laws in this case.

C - The client commits by the non inclusion on his site any forums or electronic magazines or the loading centers software or the chatting rooms fronts or the software of the free services in all forms ( like giving free areas to his site visitors or the accounts of free e-mail on the site scope name ... And so on ..) and the agreement items are clear that the sites resources should be exclusively to their owners from the industrial and commercial companies and that the site is used at the service of these companies only .

D - The data contents are defined by the commercial and industrial activities only and prevented the publication of data that contains pornographic materials or the circulation to the drugs or the sexual dopes or the data that offend the heavenly religions or the data that contradict the international laws of the hosting or the data that contradict a security and the stability of the Syrian Arab Republic or the information that expresses political viewpoints whatever it is their direction .

E - It is forbidden to publish information that causes direct or indirect damages to a person, company , enterprise or a governmental or not government organization,  and the client bears all financial damages resulting from the publication of these information and all the legal responsibilities fall upon his shoulder and Golden Fibers company abides by complete cooperation with the laws applied in the country .

F - The client commits by the intellectual property protection law applied in the Syrian Arab Republic,  and the responsibility of the legal pursuit falls upon his shoulder bearing in case of his violation of these laws and the company does not bear any surpassing by this case .

G - The client commits by the non deployment of viruses or the penetration programs or the technologies of spying or use of his site as a front for penetrating the other sites, and the client abides by the non inclusion of his site to links that point to proxy breaking sites or harmful or pornographic sites.

H - The client commits by the non use of his site as nutrition composite for the technologies of information exchange (P2P) like Torrents technologies or what is resembled ...

I - The client commits by the non inclusion of his site to software that lead to the stop of server or the reduction of its performance .

6 - The backup of the sites :

A - The company executes the sites copies that it hosts reserve daily, weekly and monthly on external servers,  and at the occurrence of programming mistakes in the agents sites, Golden Fibers company restores the last sound reserve copy for the agent taking little earnings that match the agent plan .

B - At the agent desire of keeping of reserve copies about his site on DVD discs,  he pays extra payment  arranged with the company according to the period between each copying operation and another,  and the number of  annual reserve copies that the agent wants to get them.

C - It is not legal for the agent to make reserve copies to his site in a manual way, but he requests the reserve copies from Golden company .

D - At getting mistakes in the invited sites on the company servers resulting from a disorder in these servers and not from the sites,  the restoration of the reserve copy to the sites completes free.

7 - The technical support :

A - Golden Fibers company commits to support sites technically to what concerning the problems related to the mistakes that may happen in its servers and does not abide by the programming mistakes in the agents sites except if it was the company who executed its programming as well-known by this case.

B - Golden Fibers company does not commit with the mistakes resulting from technical problems that companies suffer from providers services of Internet or the problems that may result from hiding some advantages and services from these companies ( for example the service of browsing in the protocol of the safe transfer (HTTPS(

C - The execution of regular maintenance operations or promotion on servers is legal for Golden Fibers company and notifying all agents will take place by these operations before 24 to 48 hours ... However, in the condition of the instant mistakes, the reform of these mistakes is legal for Golden Fibers company and what may cause from a stop to the servers without notifying the agents so that it does not exceed 1 % of the actual time for the work of servers .

D - Notifying of Golden Fibers company takes place for the problems that the agents may suffer by the connection with the technical support telephones numbers within the period of the work of the company which is clarified in the page (contact us in the site ) or through sending e-mails to explain the problem and to contain the site scope name and the control panel user name without need for the mention of the secret number and, the response to solution of these problems will be  within further period of 24 hours.

E - The company does not commit with the problems resulting from the leakage of secret words of control  panels of the agents and to what results from a big disorder in the site. The periodic change of the control panels secret words and the use of the difficult expected secret words fall upon the client shoulder ( big and small English letters with mixture of numbers and special letters like ... @!$؟  ...)

8 - The rights of benefit from the services of hosting :

The services, that Golden Fibers company offers, will be considered special for the agent and his company,  and the dedication or investment or distribution of these services to any other authority is not legal for any reason s without notifying Golden Fibers company and its written approval for that .

9 - The renewal of services :

A - The client commits, at his desire for the renewal of his benefit from the services that Golden Fibers company offers at the approach of the period of its reaching, with the payment of the required cost before  15 days from the end of the main period, and the company tells all its clients about the service end period before 30 days from the expired date.

B - Golden Fibers company does not commit with the renewal of services if the client abstains from the repayment of the cost  and the client bears  the result of the loss of his site scope name, and it is not legal for him to ask the company for any financial or moral compensations.

10 - The cancellation of services that the company offers to its clients :

A - It is legal for Golden Fibers company to cancel the services offered to the agent without his approval in case of the non complete costs payment due to his request of one of the services that the company offers and that will be after 7 days of notifying him from the company, and the restoration is not legal to him  for what he paid previously, or asking the company for any financial or moral compensation about the services cancellation. It is legal for the company to cancel the services if the agent does not pay the cost of the renewal without his approval after telling him from the company as explained in the item 9 – A.

B – It is legal for Golden Fibers company to  cancel the services that offered to the agent without need for his approval and without prior warning in case of his violation to the other agreement items from 1 to 8 and what mentioned in it as complete subsidiary details and it is not legal for the agent to ask Golden Fibers company to any moral or material compensations .

C - The transfer of services that Golden Fibers company offers is legal for the agent and in any time he wants to any other company by writing official request personally, signed and sealed by the company name after the repayment of the fees if founded, and it is not legal for the agent to ask the company for any cost  in case of that he did not fulfill the time period for the services, and the operation the data transfer of the agent site and what results from that as technical matters fall upon the company shoulder transferred into it.
